SB 791 and AB 810 Procedures

Overview

As of April 14, 2025, UCLA Campus is implementing California SB 791 and AB 810 in support of the University’s commitment to maintaining, building, and supporting an inclusive, healthy, and safe working environment.

What is SB 791? 

On October 7, 2023, Governor Newsom signed Senate Bill (SB) 791 into law, which requests the University to: 

A. Require applicants to disclose any final administrative or judicial decisions issued within the last seven years from the date of submission of an employment application determining that the applicant committed sexual harassment. 

B. Permit applicants to disclose if they have filed an appeal with the previous employer, administrative agency, or court, if applicable. 

The University intends to apply the requirements of SB 791 to all final candidates for staff positions, including student employees, who accept a conditional offer of employment. 

What is AB 810? 

On September 27, 2024, Governor Newsom signed Assembly Bill (AB) 810 into law, which expands SB 791 with the following requirements for Athletic Head Coach, Athletic Assistant Coach, Athletic Trainer, or Supervising Athletic Trainer positions, and volunteers in an athletic department

A. Require the final candidate to sign a release form that authorizes the release of information by the applicant’s previous employers to the UC location concerning any allegations of misconduct, as defined in the statute. 

B. Make a reasonable attempt, using the signed release form, to obtain information from the previous employer concerning any allegations of misconduct. This authorization will permit the UC location to request the release of information, which will then be evaluated to determine the candidate’s ability to perform the job duties of the position. 

The University intends to apply the process outlined in AB 810 for any final candidates who accept a conditional offer of employment for the following roles mentioned above

Department actions required

UCLA departments will need to inquire about any misconduct for final candidates, as well as provide information regarding misconduct for final candidates from other organizations. Refer to workflows below. 

Positions affected

Staff positions, including those being hired into Senior Management Group (SMG), Managers & Senior Professionals (MSP), and Professional & Support Staff (PSS), represented and non-represented staff positions, student employee positions, as well as volunteers in an athletic department.

AB 810 also applies to tenure-track/tenured faculty appointments. If you have questions related to faculty and academic appointees, please contact your local Academic Affairs & Personnel Office for guidance.

Impact to the recruitment process

As of January 1, 2025, to comply with requirements of SB 791 and AB 810: 

  • All UCLA Campus departments are required to follow the appropriate workflow below to engage in processes of obtaining disclosures of misconduct from final candidates.
  • Account for possible additional time to address pre-adverse and/or adverse actions with applicants with disclosed or discovered misconduct.
  • UCLA Campus will enlist the Universal Background Screening (UBS) vendor for routing and collecting misconduct disclosure information.
  • A notification for the Employment Misconduct Disclosure requirement is included in our job posting disclosures.

UBS Account Setup

A UBS Account must be established with CHR Employee & Labor Relations so your department.

  • Contact Ricky Terriquez, rterriquez@chr.ucla.edu to establish an account and determine the appropriate
  • UBS User Type.
    • UBS Standard User (Preparer):
      • Orders Background Checks for their own department billing ID
      • Orders SB 791 and/or AB 810 Misconduct Checks for their own department billing ID
      • Receives email notifications when results are available
      • CANNOT view any Background Check or Misconduct Check results
    • UBS AB/SB Admin Access User (Submitter):
      • Orders and view Background Check results for their own department billing ID
      • Orders and view SB 791 and/or AB 810 Misconduct Check results for their own department billing ID
      • Receives email notifications when results are available
      • CAN see results for Misconduct Check results they ordered for their own department billing ID
      • CANNOT see Background Check results they ordered for their own department billing ID
    • System Admin User (CHR Admin)
      • Order and view Background Check results for ALL department billing IDs
      • Order and view SB 791 and/or AB 810 Misconduct Check results for ALL department billing IDs
      • Receives email notifications when ALL results are available
      • CAN see results for all submitted Background Checks and Misconduct Check results ordered for ALL department billing IDs
  • Universal Background Screening (UBS)
